Sean Vetter (Vin Diesel) and Demetrius Hicks (Larenz Tate), who are ex-thugs who have become cops, are members of the US DEA working on the California/Mexico border. After arresting a drugs baron named "Memo" Lucero (Geno Silva), the mysterious "Diablo" steps into his place and organizes the assassination of Vetter's wife, Stacy (Jacqueline Obradors).
Looking for revenge, Vetter starts to act outside the law to punish his wife's murderers. To accomplish that, he asks Memo, who's now in prison, for help finding Diablo. With Hicks' help, he hunts every member of the cartel from the bottom to the top of the organization's hierarchy and what he finds is that "Memo" is linked to the recent activities...

A lawsuit was filed by Blizzard Entertainment, a computer game company, creator of the Diablo computer game series, arguing they had trademarked the title Diablo and intended to make a movie based on their game. Initially the ruling was favorable to Blizzard, but this was later overturned.
In Brazil, as well as Greece, the movie was advertised as O Vingador and O Timoros respectively, which is the same name by which the Marvel Comics' "The Punisher" character is published in those countries.
Vin Diesel and Timothy Olyphant, both play in the movie. Olyphant would later be cast in the upcoming Hitman movie, taking Diesels place.
